The US Supreme Court decision of 1998 said if public TV sponsors a debate, he or she can be left out if he or she has a miniscule campaign organization.  The US Supreme Court said nothing about using polls.  Max Linn has a big campaign apparatus, with paid staff, a budget of over $1,000,000, and TV advertising.</description>
