New LP Michigan Lawsuit

Libertarian Party of Michigan Chair Michael Saliba and associates have filed suit  against Libertarian Party of Michigan Chair Andrew Chadderdon, LPMI Secretary Daniel Ziemba, and associates. The suit was filed in State Circuit court in the County of Cheboygan.  The suit claims that the state party bylaws constitute a contract with the members, Messrs. Chadderdon, Ziemba, et al., violated the bylaws, therefore there has been breach of contract within the jurisdiction of the court, so injunctive relief is requested.

You can read the filing here.

The issues are the validity of the recent LPMI National Delegate Selection Convention and the asserted requirement for LPMI Secretary Ziemba to submit to the Libertarian National Committee (LNC)  the list of Libertarian National Convention delegates elected at the recent state convention. The requested relief is that Ziemba be ordered to submit the list, and that Chadderdon, Ziemba, etc. be forbidden to withdraw or alter the list without permission of the Court.

Saliba and associates maintain that the state convention was valid, it elected 33 delegates to the National Convention, and therefore the Secretary is required to forward that list to the LNC.   It is asserted that the list has not been forwarded.   The litigants go into considerable detail about challenges to the seating of a small number of delegates to the state convention, maintaining that they were properly seated by vote of the convention.
