States Call for LNC ExComm Censure

We are advised that at least eight states have passed resolutions condemning the Joint Fundraising Agreement with the Kennedy campaign.

The current list of states reads Louisiana, Mississippi, Idaho, Missouri, Oklahoma, Texas, South Carolina, and Utah.

We have received a copy of the Utah Resolution, but gather that most or all of them are identical. They each call for the censure of National Chair McArdle and a majority of the members of the LNC ExComm. The Resolution reads

Resolution  Against the  Kennedy Victory  Fund

WHEREAS, it was established by the delegates present at the Libertarian National Convention on 26 May 2024 to have Chase Oliver and Mike ter Maat as the Libertarian nominees for President and Vice President respectively

WHEREAS, in contravention of the delegates and members of the National Libertarian Party, the National Libertarian Party Executive Committee voted on 11 July 2024 to enter into an agreement with a rival candidate for the purposes of fundraising (now known as the Kennedy Victory Fund)

WHEREAS, the procedure used to vote on the agreement violated Article 9, Section 4 of the National Libertarian Party bylaws

WHEREAS, the agreement itself violates multiple National Libertarian Party bylaws, including but not limited to:

Article 2, Sections 1, 2, 4.

Article 5, Section 4

Article 14, Section 4

IT IS THEREFORE RESOLVED that the Utah Libertarian Party opposes any action that is in  contradiction to the National Libertarian Party bylaws and to the rightfully elected Libertarian Party nominees for President and Vice President, Chase Oliver and Mike ter Maat

IT IS FURTHER RESOLVED that the Utah Libertarian Party calls for the censure of the following National Libertarian Party Executive Committee members for knowingly and willfully violating the above National Libertarian Party bylaws:

a. Angela McArdle

b. Pat Ford

c. Andrew Watkins

d. Kathy Yeniscavich

Adopted August 7, 2024

Utah Libertarian Party Executive Committee

The Resolution Against the Kennedy Victory Fund presented to the County Representatives of South Carolina to be voted upon differs slightly from the one shown in Third Party Watch. In the two Resolved clauses in Third Party Watch it states at the end the moving party as “Utah Libertarian Party” while in the document presented to SC for a vote it stated “Libertarian Party of Louisiana as moving party in both instances.

Also the document presented to SC stated there were violations of LP Bylaws stated
as Article 2, Section 5 and Article 14 Section 1. These were not reflected in the document in Third Party Watch.

No aspersions. Wondering, why the discrepancies?

Apparently all the resolutions are not quite the same.We printed the one we had on hand. We are not privy to the workings of whoever generated the resolution and persuaded states to agree to it.
