Michigan Trademark Ruling Appealed

One of the factions of libertarians in Michigan has appealed the court ruling on Trademark ownership of the Libertarian Party name.  You can read the whole 56 page appeal at

The appeal is from the Saliba faction, which includes many of the state’s long-term Libertarian Party activists.

Oversimplifying considerably, the major aspects of the appeal include (i) contrary to the District Court ruling, the Lanham Act on Trademarks is confined to commercial speech, which is speech solely related to the economic interests of the speaker, (ii) the request for injunctive relief was in error because the LNC has not revoked via the required 3/4 vote right of the Saliba faction to use the name, (iii) LNC claims of irreparable damage are false, and (iv) public interest in free speech weighs against the injunction.
