In the lawsuit of the Saliba group over the appointment of Michigan delegates to the Libertarian National Convention, the Federal judge ruled that the matter was not ready for his consideration, in that the plaintiffs had to go through the Michigan LP Judicial Committee first.  That’s a highly standard outcome; internal processes need to be exhausted first.  There was thus no ruling on the merits of the case.

The delegate list voted by the Convention had already been sent to the National Convention credentials committee, but in principle the Michigan state chair and procedural activity within the state party could still remove delegates and replace them.  To our knowledge, the State Chair has not yet attempted to do this.

The Judge did discuss the merits of the case, saying “Based on my admittedly limited understanding of Robert’s Rules of Order and their details, my review of the particular challenges on the question of the merits, I think I tend to agree with the plaintiffs on these challenges that the vote was held at the convention and that’s that. These challenges were brought to the convention and they rejected these challenges and that’s what the convention is there for and I may even agree with the plaintiffs that Mr. Chadderdon is acting in a fairly authoritarian manner that is inconsistent with libertarian principles and inconsistent with the will of the majority at the convention assembly and that these challenges if they were brought would not be well taken.”

    Note that this ruling was from Cheboygan County, Michigan, Circuit Court Judge Gauthier. The lawsuit filed by many of Michigan’s elected national convention delegates against the LNC-supported Chadderdon faction requested that the court order Chadderdon faction Secretary Daniel Ziemba to comply with the state convention’s direction that he promptly file the elected delegates list with the national convention credentials committee, which he was refusing to do because none of the Chadderdon faction members were elected. Ziemba only did so after he was sued, so the lawsuit achieved one of its primary goals.
