Tewksbury Appeal Wins in California; CALP Convention Must Reschedule

The appeal filed to the LP California Judicial Committee against the notice given for the 2025 California LP State Convention has succeeded.  The Appellants claimed that the notice for the 2025 California State Convention was inadequate, in that most members were not notified in a timely way in accord with California bylaws.  The Judicial Committee finding directs that the convention be rescheduled so that proper notice can be given, and that such notice actually be given.

      Ah think Nolan’s Duty knows exactley that that they are wrong and their defence of the California LP shenanigans which is intended to tip the LPCA convention to supporting the corrupt MisNamedCaucus leadership retain control of the state party.

      Yea, the rest of us know too Malagan…

      Remember, anyone using a fake name is by definition a troll. Some of them are controlled or influenced by one side or another.

      For all we know, one of them may actually be McAddled. Very difficult to tell, although not impossible if you have the right tools and the time to trace things.

    If the initial notice was void then the instructions or order should say so… No need to “make it clear that [the new notice] supersedes the previous 2025 convention notice.”

    The LPCA JC decision is relying on an email from the Chair rather than an email from the Secretary to explain why they believe there’s not enough notice time. Weird. That’s not the Chair’s duty but the Secretary who did post the notice 123 days ahead of the convention (satisfying notice).

    Here its clear that the LPCA JC have created a new notice standard. This is legislating.

      “On October 22, 2024, the LPCA Secretary, Mr. Chris Edgar, sent an email to the lpca-business@googlegroups.com email group with the subject line, “10/21/24 Executive Committee Meeting Summary.” In the Summary the Secretary included “1. The Excom set the 2025 LPCA Convention for the following location, dates and time,” which included the dates of the convention to be February 22-23, 2024. ”

      That wasn’t an email to the membership. Which is the rquirement.

      “Notice to membership is clearly defined: (RONR 12th edition, section 9:5, emphasis added): When notice is required to be sent, unless a different standard is specified that requirement is met if written notice is sent to each member either:

      a) by postal mail to the member’s last known address; or

      b) by a form of electronic communication, such as e-mail or fax, by which the member has agreed to receive notice. Per the LPCA Bylaw 5: D. All references in these Bylaws and Convention Rules to “mail,” “written notification,” or similar terms shall be considered to include electronic communications. Therefore, email notification to all members is sufficient to fulfill this obligation. “
