McArdle Blocks Secretary from Internal Discussions

We are advised that the LP National Chair has barred the LP National Secretary from the internal party lists and other party records.  As a result, National Secretary Harlos is unable to participate in the business of the party.  We quote the message from McArdle:

After speaking with counsel about the matter, we are giving you an LP email address. The bylaws mandate you “shall be the recording officer of the Party and shall perform such duties as are assigned by the Chair or the National Committee… shall attend all meetings of the National Committee and all Party conventions and shall act as Secretary thereof, keeping such minutes and records as necessary.” I will work with staff to get you re-added to the private list. In the meantime, you have not shown any difficulty contacting us all via email.

We will not be returning the secretary@lp.org email to you. We are considering how to handle WordPress access. If there are other things you need according to bylaws, please cite the relevant bylaw so we can comply with it. We are bylaws compliant right now. No one is blocking you from meetings or minutes. The duties I am assigning you right now, pursuant to the bylaws, are to keep minutes and records as necessary. Please keep them and send them to us as needed. You are not instructed to re-do any past minutes that have already been completed. If there are any records that you feel must be kept and you are having difficulty keeping them, please share with us so we can find a way to make that work.

As of now, your rights are not being violated. You are reinstated as secretary and able to record minutes and attend meetings. I am advising everyone on this board not speak with you because you are still actively suing us and trying to use the Courts to usurp the will of the LNC. A few LNC members have already blocked your email address so they don’t have to read your frequent emails. I will keep them updated.

    Thank you for sharing this.

    I disagree with the LNC here that they are “bylaws compliant”. I think the LNC’s fiduciary duty requires them to wait for the JC to provide an explanation to them that comes in a written decision. Otherwise, the LNC is knowingly violating their bylaws because the JC wrote a simple instruction for them to do so. Waiting for a written decision has been the custom for 16 years. The LNC should have waited to reinstate until then. Convenience doesn’t allow bylaw violations either.
