LNC ExComm Motions Pass

Motion is We will recommend to the LNC that they adopt our recommendation to ratify the decision to dismiss the derivative suit.

McMahon: This is kind of a formality as it has already been submitted.  We should consider what is the best option for the LNC?  Is this the best option? The motion has already been filed and is being considered by the judge.  In the future we should be more engaged in the matter.  Everyone involved has an agenda.

Nekhaila: In the future we could create a litigation committee instead of handing it off to the attorneys.

Ford: What did this cost us?

Nekhaila: We spent $25,000 or so, so far.  Recovery is actually difficult.

Redpath was muted. It was not clear that he can unmute.  They move to a vote:

Vote was 5-0, Watkins being absent.

Motion to recommend to the LNC that we become a coplaintiff in the New Mexico suit.

Darr: We already allocated $5000.

Vote is 5 yes, 0 no, Watkins being absent.

Ford criticizes the $25,000 that was spent on litigation.

Ford praises Massachusetts Libertarians for testifying in favor of “Defend the Guard”.

Project Archimedes 2 has apparently raised $39,000 on an investment that is an eight or a tenth of that.

Oliver Hall, party counsel, discusses the NM matter.  Free NM petitioned to put Oliver on the ballot, succeeded, but Secretary of State put Oliver on the ballot as Libertarians. Following the election, Secretary of State disqualified Free NM Party; they did not get 2% of the votes for President, because the candidates were not on the ballot.

Case is a bit quirky.  Secretary of State said they would answer the LNC demand letter, but never did. LNC had actual money damages, the petitioning campaign that the NM Secretary of State frustrated.
