The key points read
A. The decision of the Judicial Committee of the Libertarian party of Michigan.. Purporting to invalidate the election of 27 delegates to the 2024 Libertarian Party National Convention was rendered outside the scope of proper authority of the Judicial Committee and was not based on any plausible reading of the Bylaws of the Libertarian Party of Michigan.
…
D. Accordingly, it is ordered that defendant Ziemba shall, within one hour of receipt of this order and no later than 10 AM on Thursday, May 23, 2024, resubmit the names and addresses of the individuals listed on exhibit seat to the complaint in this case to the national convention credential committee, thereby recertifying that the individuals on the list are the official delegates and all delegate alternates of the Libertarian party of Michigan.
E. It is further ordered that, once defendant Ziemba submits the original list is required above, the defendants are prohibited from submitting any other document to the national convention credential committee the purport to overturn, invalidate, or modify that suspension until a hearing can be set and conducted on the issue of whether a preliminary injunction should issue.
…
H. It is further ordered that any violations of this order shall be punishable as contempt of court.
There were still shenanigans at the credentials committee. Several of them misstated the law.: they acted as if the court decision were 50/50 when in fact its burden of persuasion was quite large and the court essentially said the Jacobs argument was complete nonsense. The credentials committee then disenfranchised most of the Michigan delegates. They acted like they were punting to the convention, though in fact it will now take 7/8 to overturn.
I would bet a very large amount of money that Andrew is going to jail and the credentials committee will be civilly liable for the travel expenses of the disenfranchised delegates.
Is the order that they “be seated”, or only that their names be submitted for the national party credentials committee’s review.
No, the order is totally explicit. The LPMI Secretary is ordered to submit the original list. “Accordingly, it is ordered that defendant Ziemba shall, within one hour of receipt of this order and no later than 10 AM on Thursday, May 23, 2024, resubmit the names and addresses of the individuals listed on exhibit C to the complaint in this case to the national convention credential committee, thereby recertifying that the individuals on the list are the official delegates and all delegate alternates of the Libertarian party of Michigan.”
Wow!! That’s great news!
