  • By various votes, the Judicial Committee denies the Appellant’s requested remedy and upholds the LNC actions that are the subject of this appeal.Decided Nov. 5, 2025.
    • OpinionsBlay Tarnoff delivered an Opinion (Tarnoff Opinion (info)), joined by Stephan Kinsella and Rob Stratton, and by Rob Latham with respect to all but Part II. Rob Latham delivered a separate concurring opinion (Latham Concurring Opinion (info)). Michael Seebeck (Seebeck Opinion (info)) and Ken Krawchuk (Krawchuk Opinion not provided by Nov. 5, 2025) each delivered separate Opinions. Marc Montoni did not submit a written opinion.
    • Votes: Messrs. Kinsella, Krawchuk, Latham, Montoni, Stratton and Tarnoff voted to deny the Appellant’s requested remedies and to uphold the LNC actions at issue. Mr. Seebeck voted to deny the Appellant’s requested remedies and to uphold the LNC actions at issue except for the funds recovery.
      • Note: The Table below summarizing the votes on the Question on Reliefs Requested was prepared by the Chair and was not agreed to by Mr. Krawchuk. In JC deliberations after the hearing, Mr. Krawchuk voted as follows: “I vote to NOT VOID any of the LNC decisions in this matter.” This has been interpreted by the Chair, Mr. Seebeck as Mr. Krawchuk voting to deny the Appellant’s requested remedy and to uphold the LNC actions that are the subject of this appeal.

C Should the LNC adoption of the SIC report on June 9 be voided and remanded back to the LNC for further consideration?  A YES vote is to void the adoption, a NO vote is to sustain it. NO, 7-0
D Should the Judicial Committee void the adoption of the SIC report on June 9 even if it is procedurally valid?  A YES vote is to void the adoption, a NO vote is to sustain it. NO, 7-0
E Should the Judicial Committee void the censure motion of August 24 even if it is procedurally valid?  A YES vote is to void the censure, a NO vote is to sustain it. NO, 7-0
F Should the Judicial Committee void the funds recovery motion of August 24 even if it is procedurally valid?  A YES vote is to void the funds recovery motion, a NO vote is to sustain it. NO, 6-1
G Should the Judicial Committee declare that Party actions based on alleged material representation be null and void even if they are procedurally valid?  A YES vote is to make such a declaration, a NO vote is to not make such a declaration. NO, 7-0
