Editorial: To the LNC!

An open letter to the LNC:
Esteemed members of the LNC:
I call your attention to the recent ExComm motion urging the LNC to ratify the two prior motions to dismiss in the LNC vs Vest suit as recommended by the Executive Committee.
I strongly urge that you begin with due diligence. You are in no hurry. The motions in question were already made. The money has already been spent.
I strongly urge that the LNC as a group should meet directly with your attorneys in the case, this I gather being Akerman LLP, to have a clear understanding of the current situation. You are looking at a complex legal issue. If other persons are forwarding to you what they think that your attorneys said, then even with the best of intents there is a risk of misunderstandings.
Second, remember, you are the clients. Your attorneys can recommend choices, but you always get to decide whether or not to agree. They then get to choose whether to follow your lead or withdraw from the case.
Third, when you ask the courts to dismiss, you are taking Angela McArdle’s side in the dispute. In light of the new evidence revealed by Jake Porter and others, I would urge you to start from the beginning, and consider whether supporting McArdle is a wise choice, no matter what appeared to be the right choice when the motions were filed. A choice to support may be viewed poorly by the membership.
Fourth, Beth Vest and attorneys have proposed a settlement. You would be wise to meet with her and her attorneys, your attorneys being present, to learn directly from them what they propose. At this point in the discussion, you need first-hand information. Even with the best of intentions, second-hand reports as to what the settlement entails may include misunderstandings.

    Teaming up with McArdle is such a huge optical blunder. This LNC is face-planting more than a clumsy hydra. (and obviously there are still members I respect, I mean that “as a body” not individual members, though I disagree with every yes vote on this). Let McArdle’s attorney try to dismiss it on her own. The LNC literally has nothing to lose. This is foolish considering everything that has gone on in the past few months.
