Investigatory Committee Calls to Suspend Harlos

The LNC Committee to investigate Caryn Ann Harlos met.  I watched it via Zoom.

The five committee members —  Malagon, McGee, Ford, Nanna, Nekhaila were all present.

Chairman Malagon read a series of charges.  He called for votes without asking if there was any debate, i.e., no debate was permitted. He took the roll, never calling on himself or stating his vote.

In this reporter’s opinion, Malagon has a great future as a tobacco auctioneer.  He spoke entirely clearly but a mile a minute or more, so my description of the motions is very much descriptive rather than text accurate.

Charge one, specification one: Gross misconduct, violated autonomy of Colorado Party by putting Chase Oliver on the ballot. Vote was 3-2, Nanna and Nekhaila voting against.

Specification two:  Gross misconduct, failed to failed to follow the instructions of the Chair. Vote was 4-0. Nanna abstained

Motion to adopt Charge One in full.  Vote was 4-0.  Nanna abstained.

Conduct by filing names LNC has exposed LNC to litigation Nanna abstain. Motion passes 4-0-1

Charge 2 Conduct that disturbs the well-being of the Libertarian Party and obstructed the investigation, by falsely claiming the national convention had done something. Motion passes 5-0.There may have been another charge in here; I was falling behind in taking notes.

Committee adopts a resolution to summon the Secretary, suspend her as Secretary, and appoint a manager.

Move to submit report to LNC.  Motion passes 5-0/

Move to adjourn. passes without objection.

    It should be noted that in an investigatory committee, per RONR 63:8, “members are selected for known integrity and good judgment conducts a confidential investigation.”

    Three of those members do not fit that criteria.

    Furthermore, and this is a MAJOR flaw in RONR, there is NO prohibition on the investigatory committee or the trial managers to NOT be members of the voting assembly. That is the equivalent of having the prosecution be on the jury, is a gross malfeasance of duty, and is entirely unethical.

    If the LNC members who are the trial managers and the investigatory committee have any sense of ethics, they will recuse themselves from voting at the trial.

    But don’t count on it; that honor and integrity are clearly lacking. The train on this railroad job has already long left the station.
