The Special Investigatory Committee has filed its report. It is available as a link.
The report is 34 pages single-spaced of type. It goes on in vast detail about prior actions of LNC Regional Representative Martin. Of particular note is that the relevant Regional formation agreement authorized the LNC to remove Martin subject to an appeal to the Region’s Chairs, with the LP Judicial Committee being barred from hearing appeals. I quote from the report:
Removal of a Regional Representative
Bylaws Article 7.8 provides that a Regional Representative may be removed only by act of the affiliate parties constituting the region, according to the region’s own procedure. In the 2026–2028 Regional Agreement for Region 1, which Mr. Martin himself signed as LPHI Chair on May 23, 2026, the Regional Chairs consented to removal by the LNC under the procedures for At-Large Representatives. According to the Region 1 agreement, such a removal is not appealable to the Judicial Committee and is subject to a ten-day window for the Regional Chairs to re-appoint. The Regional Chairs further consented to suspension of LNC membership rights during the investigation “if necessary to protect the LNC from breaches of fiduciary duty”. The SIC considers the creation and/or signing of a Regional Agreement an act of affiliate parties constituting the region; and, thereby, it considers the Agreement’s provision for suspension and removal by the National Committee legitimate.
This Editor does not see how the agreement is consistent with the LNC’s bylaws. The SIC recommended a series of charges against Mr. martin. We quote from their report:
The SIC therefore believes that the complaints described in this report are well founded as to the matters set out in the charges below, and that the following offenses warrant charges:
1. Attacks on fellow board members (Charge I). Mr. Martin called five LNC members “vile subhuman terrorists fit only for Guantanamo Bay”, agreed that “these commies need to be put against the wall”, and publicly and repeatedly accused named LNC members and Party members of federal crimes, including violations of the Foreign Agents Registration Act. See: On the Issue of Attacks on Fellow Board Members, On the Issue of Accusations of Criminality and Foreign Agency, and On the Issue of Statements Endorsing Force.
2. Public endorsement of non-Libertarian candidates for office (Charge II). Mr. Martin repeatedly and expressly noted, on the public list, that he was making “endorsements” of specific Republican candidates in Hawai’i.
3. Harassment (Charge III). Mr. Martin targeted Party members who objected to his conduct and warned LNC members about their safety at future Party events. He repeatedly called for the removal of Party members “by force and with extreme prejudice”, contrary to the Bylaws Article 4 membership certification. He also posted a poll on violent fates for Judicial Committee members during their hearing. See: On the Issue of Harassment of Party Members and On the Issue of Statements Endorsing Force.
4. Breach of the duty of loyalty (Charge IV). Mr. Martin offered to trade his seat for contributions to a private political committee, with threats if the offer was refused. See: On the Issue of Breach of Fiduciary Duty.
The SIC does not separately charge the remaining conduct described in these findings. That includes the call to “kill/muzzle the LNC”, the endorsement of other parties’ candidates, the use of Party assets and confidential information, conduct while Mr. Martin was an Alternate, and conduct for which Mr. Martin was already censured. Rather, these instances are included as evidence of Mr. Martin’s pattern of behavior and lack of awareness that any of his conduct should be tempered.
Recommendation(s)
Based on the foregoing findings and conclusions, the SIC’s primary recommendation is that Mr. Martin resign as Region 1 Representative. Resignation would spare all parties the time, expense, and further disruption of a trial. Under the Region 1 Agreement, the Region 1 Alternate would succeed to the seat unless she declined.
Should Mr. Martin be unwilling to resign, the SIC recommends that the LNC take the actions enumerated below. Importantly, the SIC notes that it has declined to recommend specific penalties in and of itself: Its role is rather the recommendation of charges. Recommending penalties falls within the purview of a trial manager and imposing them falls within the purview of the National Committee. The SIC may, however, recommend actions prior to trial; and per RONR 63:13, this includes suspension pending trial.
