LP Regional Representative Austin Martin, in his persona as a Sustaining member, has filed an appeal to the LPUS Judicial Committee. The issue is “Petitioners challenge actions taken by officers of the Libertarian
National Committee (“LNC”), subsequently sustained by the LNC at its May 2025
in‑person meeting in Michigan, which purported to void the Region 1 election of James
Wiley as Second Alternate on the basis of an alleged lapse in sustaining‑membership status.”
The appeal is short (barely more then four pages), clearly written, and is a beautiful example of the utility of of first-rate typography. There are supporting documents, notably emails on the Region 1 Elections.
Martin asserts in his cover letter that he has the required number of signatures of one sort or the other.

I had filed an amicus, but was not part of the case.
It’s a crap appeal, written by AI. Anyone claiming otherwise is either dishonest or not all there, or both.

– He was elected as Alternate #2 to the LNC by Region 1 5/10/25.
– Article 7 Section 4 says to be an LNC member, you must be a sustaining member.
– RONR 54:23 limits voting in election to eligible nominees.
– Election results sent to Secretary Harlos on 5/15/25. Credentials were checked and the lapse was discovered. Chair Nekhalia notified Region 1 of the lapse and declared Wiley ineligible, and that Wiley needed to buy a membership to eligible and then get elected.
– Wiley bought a membership on 5/15/25.
– LNC met 5/17-18/25. Wiley was not present.
– Martin raised a point of order about the election being invalidated, ruled not well-taken, appeal failed.
– Region re-elected Wiley on 5/24/25, calling it a “ratification” when in fact it was a new vote.
– Wiley resigned from the LNC 12/30/25 and joined the Republicans, claiming a run for Colorado Secretary of State in 2026.
Reality: Wiley was not eligible to be elected, so that election was voided. He was told of the problem. He fixed the problem. He was then elected and seated. The appeal is moot because the issue was resolved and the breach of the bylaws was sealed.
Martin only wants this appeal to have the Judicial Committee to cover him by indicating that a LNC member is elected regardless of standing to be so, because there’s rumors of him not signing the Pledge and being ineligible himself.
Yet there seems to be members of the Judicial Committee who want to do exactly that and make a mockery of the bylaws, determining that eligibility is irrelevant to election. You’ll know them by their words, and they should not be re-elected if they’re running.
