LNC ExComm Meeting of June 9,2026. ExComm Rejects 4-4 Pausing New Mexico Litigation

Meeting came to order at 7:01 PM.  The Secretary called the roll.  All ExComm members were present.

Agenda is discussion of the New Mexico trademark suit.  A motion to move to executive session for 45 minutes was passed.  They have gone into executive session. We remain in executive session. 10 people who are not LNC members are waiting outside; unlike Sunday’s Executive session, the waiters without are more or less entirely silent.  They have returned.

There is a motion to recommend to the LNC that it should pause litigation in New Mexico and seek a peaceful resolution that would unite the New Mexico parties.  Libertarian Sentries reports the motion as  saying

The Libertarian Party Executive Committee made a vote on a motion to recommend the National Committee to direct the Chair and legal counsel to:
– Immediately end any adversarial legal action in the New Mexico litigation dispute;
– Enter into good-faith negotiations with the Libertarian Party of New Mexico (LPNM) based on a settlement offered;
– Pursue a resolution that unifies the LPNM and Free New Mexico Party;
– Only pursue legal action strictly necessary to conduct negotiations and meet deadlines; and
– Provide updates to the National Committee until the conflict is resolved or the settlement falls through.
The motion failed by a vote of 4-4-0-0. Chair McMahon clarified after the vote that they still will be working towards good-faith negotiations with the LPNM to resolve the conflict

Chair McMahon said that he would continue to seek a negotiated solution to the dispute. The litigation will I gather continue.

    To clarify: the text is a paraphrase of what the motion was, as I could not see clearly the text when it was streamed. The exact text of the motion is as follows:

    “Move that the Executive Committee recommends to the entire National Committee that they direct the National Chair and LNC counsel to immediately halt all adversarial legal actions regarding the dispute with the Libertarian Party of New Mexico, to actively enter into good-faith negotiations based on the present settlement offer, and to pursue a resolution that facilitates the unification of the Libertarian Party of New Mexico and the Free New Mexico Party; and that the only legal actions authorized in the interim shall be those strictly necessary to conduct these negotiations or meet mandatory court deadlines. An update should be provided to the LNC by counsel at each meeting until the issue is resolved or settlement falls through.”

    I’m glad to see the chair commit to trying to work through this by negotiation.

    It’s a shame to see the executive committee refuse to drop the trademark suit, which would be meritless and frivolous even if “intellectual property” wasn’t an anti-libertarian anti-concept.
