We are led to understand that, as of the end of May, the LNC’s litigators in the New Mexico Trademark case have billed the LNC for almost the full amount of their retainer.
There are rumors that several people have counted noses and concluded that the LNC is two or three votes short of being able to disaffiliate the Free Party of New Mexico, which would allow them to affiliate the Libertarian Party of New Mexico.
We have from an unimpeachable source that Chris Luchini believes that the changes that LPNM made between their first and second offers, changes that were forwarded to the LPNM via a series of intermediaries, were originally dictated by LNC Chair Evan McMahon himself. We gather that LPNM is puzzled as to why their second offer, which was apparently believed to satisfy all LNC requests, was then voted down.
There is a federal hearing on Monday for an emergency injunction requested by the LNC. The injunction, if granted, would keep LPNM’s candidates off the ballot.
The LP of New Mexico notes that the LNC lawsuit has killed any possibility of getting major party status back for this cycle. Too much of the LPNM’s treasury was exhausted defending itself against the suit. If the suit had not been filed, LPNM believes that it had a decent shot at getting major party status back.
We have heard suggestions that some defenders of the LNC ExComm’s decision are quoting material that was said in the ExComm’s two executive sessions.
“We gather that LPNM is puzzled as to why their second offer, which was apparently believed to satisfy all LNC requests, was then voted down.” No surprise here. Hitler urged ethnic Germans in Czechoslovakia to pile demands on demands till aggression could be justified. GB sent Runciman to extract concessions from Czech prez Benes and end the crisis. But Benes on 04SEP1938 told the Sudeten leaders to dictate their terms. When they balked, he wrote down everything they had ever demanded and signed the note himself. This put England on the spot and was the opposite of what Hitler wanted. Source: AJP Taylor, Origin of the 2nd World War, Crisis over Czechoslovakia pp169-170. See on Google Books. SPOILER: Christian National Socialists went ahead and invaded.
We had a similar situation in the American Translators Association, originally run of, by and for corporate agencies. A revolt in 1980 added competency tests as a requirement for voting, thereby shifting power from agency owners to individual accredited translators. But these law-savvy companies managed to oust an elected president, establish rule by a Manager beholden to the agencies, replace mail-in voting with a proxy system putting most of the votes into their boardmember hands–a slow-motion Anschluss. The Chicago Translators & Interpreters Association seceded, and the Fifth-Column ATA used our money to set up a “Midwest” puppet association. This FAILED, and Chicata.org is still there serving individual translators and interpreters.
I managed on two occasions to send a little money to LPNM precisely because they were not associated with that thing the Jesus Caucus infiltrated and took over. Then their website went into endless loops when I tried again and again. Next time a friend travels stateside I’ll try to send a check. Meantime I support Reason, candidates I know personally, any objectivist or libertarian candidates I can find, but NEVER the Trojan Hearse.
Their site is up and running – I just donated.

Thanks so much. I timidly entered $50, did NOT invite anyone to use robodialers to harry my number–and the thing actually worked. The change I noticed is it now realized what country I’m in. My worry is that the same Kleptocracy that enforces the 1971 anti-libertarian subsidies for entrenched Kleptocracy candidates also runs the courts and pays the judges the impostors are asking to block genuine libertarian party activism via this additional fifth-column method. Cui bono?
I was hoping to be able to, in good conscience, become a $10 monthly pledger to LNC again after the national convention. But I don’t donate to grifters who use government force to try to forbid other political parties from using their own names, so LPNM just got the first two months of that prospective pledge instead.
The “new” LNC is as dysfunctional as the previous. As The Who would put it”meet the new boss same as the old boss”! Yes we’re fooled again!
IMO, the Libertarian Party wastes too much time and resources on these intramural squabbles, which seems to be what some folks intend.
What a waste of money on frivolous lawsuits that the PREVIOUS LNC instigated.
The current affiliate has no funds and is not recognized by the New Mexico Secretary of State for the Libertarian ballot line—pretty much a moot point to make the LNC do its bidding.
Shameful that the LNC would rather bankrupt itself on what is widely considered a losing case for National than it is for LPNM. So why bother wasting your time?
Sending this to arbitration would be significantly cheaper. Dropping the matter altogether is much preferable to the membership.
They didn’t want the trademark. When the LPNM left, they didn’t fight for the name. McHarlos and co just started a new party. Now that that party has failed, and they learned that the LPNM has a bank account, now they’ve decided to sue.
The Luchini group join the existing affiliate and give ballot access to that group.
By “the Luchini group,” do you mean the Libertarian Party of New Mexico? Why should they join some other party?
I mean the Luchini group. Their title to Libertarian is challenged.
“Their right to use their name is being frivolously and vexatiously challenged.”
Fixed, no charge.
There was talk of the LPNM group joining the FP before the last convention, so they could vote themselves in and just end it that way, but the Mises faction wouldn’t announce when the convention was until after it was too late to sign up as a voting member.
The latest offer from LPMN seems almost unduly generous.
It’s sickening to see the LNC suing to keep Libertarian Party candidates off the ballot, and to keep throwing money at frivolous/vexatious trademark litigation.
Republicans, Anarchists and Dems are doubtless thrilled by whatever keeps all sides of the aisle socialist.
Alicia Dearn is the attorney for the Chris Luchini group. Some may remember her when Gary Johnson was running for president.
Is that good, bad, or otherwise?
She has defrauded and withheld pay from multiple people whom she hired to work for her. She should not be trusted!
