The proposed terms are reportedly:
New Hampshire affiliation proposal
Summary
Do not pick either affiliate petition on Sept 13. Let all of New Hampshire’s members convene to create a new affiliate.
The LP commits to running, or allowing to be run, a fair, transparent, and open convention.
LPNH will surrender all assets, including but not limited to, physical property, domain name, social media accounts, and bank accounts to a new affiliate.
On Sept 13th LNC Meeting
Postpone both NH petitions.
Adopt the convention terms below.
Direct the Secretary to issue the charter on certifying the terms were met (Bylaws Art. 5 §2, Art. 7 §1). No second vote.
LPNH commits
LPNH will submit a signed letter from the entirety of the executive committee promising that:
Jeremy Kauffman will resign as chair of LPNH on adoption of this agreement, as well as pledge to hold no executive committee seat or other office in the new NH affiliate through 2030.
No current LPNH board member, and no one who voted for the Nov 2024 endorsement, runs at the new convention.
Within 30 days of the new affiliate being chartered, LPNH Inc. transfers to the new affiliate: the X account, lpnh.org, member and email lists, NH registrations and trademark, any claim to the name, our bank account, and any/all other assets desired.
Within 7 days of the LNC committing to this agreement, LPNH Inc. will stop using “Libertarian Party” on social media and its website.
These promises are valid if and only if a convention is held that meets the standard below
Convention
Notice from the LNC Secretary within 14 days to every national member on record in NH, posted on lp.org and sent via email, with skeleton bylaws and agenda attached.
The convention will be in person in New Hampshire on a Saturday after election day, but no later than 12/31/26.
A convention chair and/or committee will be appointed that is fair, neutral, and unaffiliated with either side. If “neutrals” cannot be found, then the committee must be balanced between “sides”. One strong candidate to chair is John Babiarz, who has been affiliated with the LP for a long time and would be trusted by all factions.
Every national member in good standing residing in NH as of 14 days out, credentialed from LNC records. Convention attendees must provide valid government-issued ID affirming their NH residence.
Voting done via secret paper ballot. NOTA on every ballot. Competing affiliates may assign delegates to watch the count.
All initial executive committee positions as well as bylaws are passed via majority vote.
The organization holding convention is bootstrapped with skeleton bylaws that are one page, containing a blank name, the Statement of Principles, membership terms as above, four officers, rules to handle bootstrapping convention, an Art. 5 §4 no-endorsement clause with removal, Robert’s
Rules.
LNC commits
Charter the result on certification.
Send and post the notice.
No cease-and-desist or suit against LPNH Inc. or its officers until the convention and transfer are done.
Why
No more money wasted on lawsuits (NM cost over $100k).
New affiliate will receive valuable LPNH assets.
Nobody can call the result imposed or unfair. Every NH member gets notice and a vote.
Media coverage from New Hampshire and likely nationwide.
Drive growth of the LP, show the LP is better than other political parties which cheat and play games.
The people the LNC objects to are out by contract.
One Libertarian Party in NH by end-of-year, undivided and ready to move forward.
this sounds like how the Council of Constance resolved the Great Western Schism
This is a good suggestion but it is to late for that now. The LPNH no longer exists as they were kicked out by the LNC which was approved by the judicial committee.
My suggestion for selecting an affiliate is:
1. Make the process as transparent and open as possible. No executive sessions.
2. Select a date when there will be a special meeting to select an affiliate.
3. Notify the National Party membership of New Hampshire there will be a meeting to select an affiliate for New Hampshire. Request proposals from the membership of New Hampshire for a group that wants to become an affiliate. Currently there are two proposals that have been presented. Notify those groups that have proposed they want to become the affiliate there is going to be a meeting for the selection of an affiliate, what day and time the meeting is being held, and to be prepared to make a presentation to the LNC.
4. The day of the meeting select a process to decide which group making a presentation will go first. The first presentation will be up to 20 minutes. After the presentation is made the members and alternates of the LNC will have up to 10 minutes to ask questions of the person who just made the presentation. The next group making a presentation goes next. They will have up to 20 minutes to make their presentation. Then members and alternates of the LNC will have up to 10 minutes to ask questions of the presenter. After, if there are other proposals from other groups the same procedures previous used will apply.
5. If needed a break will be taken by the LNC.
6. The LNC will then decide which group will receive affiliation. Parliamentary procedures will be used to decide the question. Open and frank discussion will be allowed by the members and alternates of the LNC. A vote will be held to decided the motion which group will be recognized as having affiliation.
7. The group receiving affiliation will be notified they received affiliation and those groups not receiving affiliation will be notified they did not receive affiliation. National members of the Party residing in New Hampshire will be notified there is a new affiliate and which group has been recognized as having affiliation.
Key points: Make the process as transparent and open as possible. No executive sessions. Open and frank discussion by the members and alternates of the LNC will be allowed. Parliamentary procedures will be allowed to decide the question.
Bad faith actors should be laughed away. It was a threat disguised as an offer. The activists who had to suffer under these fools are the ones to be recognized.
